Statement of Accuracy:

All patient data submitted to BRAINWAVE REPORTS™ (BWR) via the WAVi™ Wellness form must be accurate. The attending physician or qualified technician responsible for the WAVi brain testing and billing system must review thoroughly the accuracy of the input submitted to BWR before an official neuro-certified patient assessment can be generated.

WE MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, ADEQUACY, VALIDITY, RELIABILITY, AVAILABILITY, OR COMPLETENESS OF ANY INFORMATION SUBMITTED TO BRAINWAVE REPORTS™. Testing Policy and Recommendation:

BWR provides data interpretation assessments from an expert Neurologist. The BWR team does not treat patients and its focus is on reviewing the raw EEG data, objective brain data, behavioral markers, and executive function. Our narrative, impressions, recommendations, and treatments are based on what has been produced by the medical testing team. 

BWR requires that the Neuro Testing facilities testing PI patients remain diligent in submitting the best quality EEG, P300, and Executive Function testing. There will be occasions when a technician may need to retest a patient to produce a better test. Patients can often be nervous to begin with and the sensitivity of an EEG will require an additional P300.

BWR recommends in all cases that an Evoked Response Visual (aka. Flanker Test) be given to all patients. This will provide additional data that can be used.

Please note the following additional conditions and disclaimers that apply to the use of the BWR reports and services:

  1. Use at Your Own Risk: All BWR services, including but not limited to, the interpretation of EEG data, are provided on an ‘as is’ and ‘as available’ basis. BWR is not responsible for any damage, injury, or loss of any kind arising from the use or inability to use our services. By using our services, you agree to accept such risks and agree that BWR will not be liable for any errors, omissions, or defects in the service or data provided.
  2. No Guarantees: While BWR takes great care in providing accurate and reliable data interpretations, no guarantee can be made regarding the accuracy or reliability of the interpreted data. The analysis and interpretations provided by BWR should be used as a supplemental tool in conjunction with other diagnostic procedures and should not replace professional medical advice.
  3. Liability Limitation: As to the provision of BWR services, not covered in the disclaimer of testing data accuracy, total liability to you or any third party for any damages arising out of or related to the services provided, whether in contract, tort or otherwise, shall not exceed the total amount of fees paid by you to BWR for services provided up to and during the six (6) months prior to the claim.
  4. Indemnification: You agree to indemnify, defend and hold harmless BWR, its officers, directors, employees, agents, licensors, suppliers, and any third party information providers from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this agreement or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the service using your account.
  5. Data Responsibility: BWR is not responsible for any issues or inaccuracies with the raw EEG data or other input data provided by you or your team. The quality of the BWR reports relies heavily on the quality of the input data, and BWR assumes no responsibility for errors or omissions in this data.

By using the services provided by BWR, you acknowledge that you have read, understood, and agree to these terms and conditions. If you do not agree with these terms, you should not use the services provided by BWR. Please consult your legal advisor before proceeding with our services.
